Understanding TN Visas For Mexican and Canadian Citizens

The TN visa is a temporary work visa available to certain professionals who are citizens of Mexico and Canada. The TN allows certain Canadian and Mexican citizens to enter the U.S. temporarily to engage in professional employment. While Canadians can apply for a TN visa directly with CBP officers at the border or airport before they board a plane, Mexicans must apply for a visa at a U.S. consulate. Spouses and children may be issued TD visas to accompany or follow to join the TN visa holder.

Requirements and Stipulations

The TN visa requires proof of the following:

The applicant must be a citizen of Mexico of Canada.
The applicant’s profession must be listed under the regulations (many professionals such as engineers, lawyer and pharmacists are listed; but not all professionals qualify).
The applicant must be coming to work full-time or part-time with a U.S. employer (self-employment not permitted), as evidenced by an employer letter.
The applicant must possess the specific educational and/or work experience required for the profession they seek to work in.

Spouses and Children of TN Visa Holders

Spouses and unmarried children under 21 may accompany the TN visa holder to the US, and can be given TD visas for dependents. TD visa holders are not allowed to work in the US.
